Welcome to The Midas Collection. These Terms and Conditions (the “Terms”) govern your use of themidascollection.com (the “Site”) and every purchase you make through it. The Site is operated by Midas Jewelry LLC, doing business as The Midas Collection (“The Midas Collection,” “we,” “us,” or “our”), 701 W. Lantana Road, Lantana, FL 33462. By using the Site or placing an order, you agree to these Terms. If you do not agree, please do not use the Site.

1. Eligibility

You must be at least 18 years old and able to enter into a binding contract to make a purchase. We sell to customers with a shipping address in the United States, including Puerto Rico.

2. How We Fulfill Your Order

Many of our pieces are crafted, finished, and shipped directly to you by our trusted U.S. manufacturing partner. Some items are kept in stock; others are made to order or set and finished after you order. Estimated production and shipping times are shown on each product page and at checkout and are estimates, not guarantees.

3. Product Information

  • We make every effort to show our jewelry accurately. Photographs may be enlarged to show detail, and color, size, and finish may vary slightly with your screen and with the natural characteristics of metals and gemstones.
  • Weights, measurements, and carat totals are approximate and may vary within industry-standard tolerances.
  • Gemstone treatments. Many colored gemstones are routinely enhanced (for example by heating, oiling, or irradiation) to improve their appearance. Unless a product is described as untreated or natural, you should assume the gemstone may be enhanced. Some enhancements may require special care. Contact us for details about a specific piece.
  • Diamonds. Natural diamonds we offer are sourced from suppliers who comply with the Kimberley Process and the System of Warranties. Lab-grown diamonds are always identified as lab-grown.
  • Where a grading report or certificate is included, it is issued by an independent laboratory, and we are not responsible for that laboratory’s opinions.

4. Pricing and Availability

  • All prices are in U.S. dollars. Prices of fine jewelry depend on the market price of gold, platinum, and other precious metals and may change without notice. The price charged is the price shown when you place your order.
  • Availability is confirmed in real time with our supplier, but an item may still become unavailable after you order. If that happens, we will contact you to offer an alternative, a revised delivery date, or a full refund.
  • We may correct errors in prices, descriptions, or availability at any time, including after an order has been placed. If an item was listed at an incorrect price, we may cancel the order and refund any amount you paid.
  • Applicable sales taxes are calculated at checkout based on your shipping address.

5. Orders and Payment

Your order is an offer to buy. We accept it when we ship the item or confirm that production has started. We may refuse or cancel any order, including for suspected fraud, inability to verify payment or identity, or pricing errors; if we do, we will refund any amount charged. For high-value orders we may ask for additional verification before processing. Payment is due in full at checkout through the payment methods offered on the Site.

6. Cancellations

You may cancel an in-stock order at no charge until it has shipped. Made-to-order, sized, engraved, or otherwise customized orders cannot be canceled once production has begun, because labor and materials have already been committed; in some cases we may agree to cancel in exchange for the costs already incurred. To request a cancellation, email info@midasjewelry.us as soon as possible with your order number.

7. Shipping, Title, and Risk of Loss

We ship to addresses in the 50 U.S. states and Puerto Rico. All shipments are fully insured and tracked, and an adult signature may be required at delivery. We cannot ship to P.O. boxes for high-value orders. Title and risk of loss pass to you when the package is delivered to the shipping address you provided. Please inspect your package on arrival and report any damage or missing items within 48 hours, as described in our Returns & Exchanges Policy.

8. Returns and Exchanges

Returns, exchanges, and refunds are governed by our Returns & Exchanges Policy, which is part of these Terms.

9. Limited Warranty

We warrant to the original purchaser that each item will conform to its description and be free from defects in materials and workmanship under normal wear for 30 days from the date of shipment. If an item does not meet this warranty, we will, at our option, repair it, replace it, or refund the purchase price, and we will cover reasonable shipping costs for the warranty return. This warranty does not cover normal wear, loss of stones caused by impact, damage from accidents, misuse, chemicals, or improper care, or alterations or repairs made by anyone other than us or our manufacturing partner.

EXCEPT FOR THE LIMITED WARRANTY ABOVE AND TO THE EXTENT PERMITTED BY LAW, ALL PRODUCTS AND THE SITE ARE PROVIDED “AS IS,” AND WE DISCLAIM ALL OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. Some states do not allow these limitations, so they may not apply to you.

10. Limitation of Liability

To the fullest extent permitted by law, The Midas Collection will not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Site or any product, and our total liability for any claim relating to a product will not exceed the amount you paid for that product. Nothing in these Terms limits any rights you have under applicable consumer protection laws that cannot be waived.

11. Accounts

If you create an account, you are responsible for keeping your login details confidential and for all activity under your account. Notify us immediately of any unauthorized use.

12. Intellectual Property and Acceptable Use

All content on the Site, including jewelry designs, photographs, text, logos, and graphics, is owned by us or our licensors and is protected by copyright and trademark law. You may not copy, reproduce, scrape, or use Site content for commercial purposes, for resale listings, or to train artificial intelligence models without our written permission. You agree not to misuse the Site, interfere with its operation, or attempt to gain unauthorized access to it.

13. Privacy

Our Privacy Policy explains how we collect and use your personal information.

14. Force Majeure

We are not responsible for delays or failures caused by events beyond our reasonable control, such as natural disasters, severe weather, carrier disruptions, supply shortages, or government actions. In such cases delivery dates will be extended for a reasonable time.

15. Governing Law and Disputes

These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law rules. Before filing any claim, please contact us at info@midasjewelry.us so we can try to resolve the issue informally. Any legal action must be brought in the state or federal courts located in Palm Beach County, Florida, and you consent to their jurisdiction. To the extent permitted by law, any claim must be brought within one year after it arises.

16. Changes to These Terms

We may update these Terms from time to time. Changes take effect when posted on this page and apply to orders placed after that date.
